2. GENERAL TERMS

2.1       All sales are final.  Except as provided below, we do not accept cancellations or provide refunds.

2.2       We do not accept returns of food products or retain merchandise.  If you are dissatisfied with Your purchase for any reason, we invite You to contact us via the link on this website to request a refund.  Refunds will be evaluated and considered based on the facts of each individual transaction.

2.3       You assume the risk of loss or damage to Your product once it has left our facility.  Ma Brands is not liable for any damage or destruction of Your product due to shipping or handling once it has left our fulfillment facility.

2.4       All of the food products purchased through this website contain peanuts, peanut oil, other nuts and derivatives of nuts and peanuts.  We also identify the ingredients of our food products on the packaging.  Do not consume this product if you have food allergies.  Ma Brands (including its successors and assigns) is not liable for any injury or damage You experience due to allergic reactions to Our products.

2.5       You release Ma Brands, its owners, agents, successors and assigns from all claims, damages, and causes of action or liabilities which arise as a result of your consumption of our products.

2.6       We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

2.7       We reserve the right at any time to modify, substitute or discontinue any or all of our products without notice at any time.  We reserve the right, but are not obligated, to limit the sales of our products to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products are subject to change at any time without notice, at Our sole discretion.

2.8       Images of food on the website are provided to give you an understanding of the finished products and shall not be construed as a guarantee of the image of the actual product.  Images on the website may include items that are not part of the actual product sold.

2.9       Nutrition information is based on the best information available but are only approximations. 

2.10     We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations.

2.11     You agree to indemnify and hold Ma Brands, its officers, directors, members, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against Ma Brands by any third party due to or arising out of or in connection with Your use of the Site.

3. DISCLAIMER

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXCLUDE ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS RELATING TO OUR WEBSITE AND THE USE OF THIS WEBSITE.  THIS INCLUDES, WITHOUT LIMITATION:

• THAT THE MATERIAL IS OF ANY PARTICULAR LEVEL OF QUALITY, MERCHANTABLE, OR FIT FOR A PARTICULAR PURPOSE.
• THAT THE FUNCTIONAL ELEMENTS CONTAINED IN THE MATERIALS WILL BE UNINTERRUPTED OR ERROR-FREE.
• THAT DEFECTS WILL BE CORRECTED.
• THAT OUR SITES OR THE SERVERS THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

4.3       This Agreement and the Privacy Policy together constitute the entire agreement between You and Ma Brands.
